Should I own my safe deposit box in my trust or individually?
We generally advise that you have the safe deposit box in the name of the trust, so that the successor trustee can gain access to the box easily without waiting 40 days after your passing and filing a small estate affidavit. When the box is in the name of the trust, your successor trustee only needs the death certificate, trust agreement, and tax ID to gain access, making it simpler for everyone involved.
