Orange County Estate Planning Attorney James F. Roberts Discusses things to consider when creating and modifying your estate plan.
You May Need To Consider The Benefits of Creating an IRA Sub-Trust
One of the reasons you may want to name a trust as beneficiary to your IRA rather than your children is that they may not be good with money management. Rather than having them blow through the money, you can name the trust as being in control of the IRA and create an IRA sub-trust. The Trust does have to distribute the required minimum distribution but the rest can be growing tax deferred and you can distribute to them in a way that it actually benefits the beneficiary and not let them go through the money too quickly.
IRA Beneficiary Sub-Trusts
So if you have beneficiaries that are not good with money management you may want to consider an IRA beneficiary trust as a way to protect the assets for them and provide for them longer term.
